Sub:    Examiner Press Building

Ref:     Your letter A04-006 of 3rd, August, 2013

This has reference to your letter dated 3rd, August, 2013; in relation to Examiner Press Property. Your letter clarifies that what was just a perception based on a letter from one concerned member of Laity, has been confirmed that a DEAL is in offing to dispose off this property….

At the onset, would like to put on record that we are not in the business of property dealings, but only highlighting the untoward deeds by people at the helm in Estate Office. Therefore, your request/ instruction / order, to find better offer within a month is misplaced, because it is based on illogical advice provided by your Finance Committee.

However, in this context, we expect you to extract answers to following questions, which are always on the minds of members of the Laity, under such circumstances.

  •  Will the property remain in possession of Church or can it be easily retrieved, if it is leased and not sold? (This question is in the context of your statement that ‘the leasing, not sale of The Examiner Press Property.)’
  • What is the best interest of the Church; in this deal/leasing of this property, as your letter states?
  • How the offer was evaluated to arrive at the conclusion that it is the best deal in the interest of the Church?
  • Do the members on the panel have the expertise to decide the value of deal of such magnitude? Who are those members and what is the value of the deal?
  • What is the number of offers received, from which this particular offer was selected?
  • Was the decision to lease the property made public, inviting offers, through Advertisement in any of the renowned news papers, apart from the Examiner, if at all it was advertised? Please let the Members of Laity know about it.
  • Finally, it is needless to say that Church properties are governed under Bombay Trust act, 1950. Under such circumstances, as per our knowledge, Prior approval from Charity Commissioner is necessary. Has it been obtained in the case, where Estate office is in the process of Leasing the Examiner Press Property?

Your Eminence, if all the above parameters have been met with, in concluding the deal, let the Estate office go ahead with it; but not before bringing  into public domain the terms and conditions of the deal. Otherwise, please reject it out right.

It is well-known, the Church properties have been clandestinely disposed off by so called SOLE TRUSTEES, bypassing above mentioned parameters, at the parish level, in connivance with some members of Laity, installed on Property Committee, by Parish Priests; about which we have been writing to you regularly.

In the case of Examiner Press Property, an attempt was made in around 2010, to sell it; but was stalled by intervention of one Mr. Bruno De Sousa, a Parishioner of St. Francis Xavier Church, Dabul; claiming to be the beneficiary of Archdiocesan Trust.

We concur with him that all the members of Laity are the beneficiary of Church properties; therefore have a right to voice their concern.

We are sure, the explanation is enough for you to use your discretion and save this prime property from going into the hands of outsiders, without any benefit to Church and Community as whole.

Your Eminence, perception in the minds of Laity at large is that such activities are carried out with your Blessings. Prove them wrong with positive action on this front.
