BMC misguides Chief Minister into making irrelevant statement in Legislative Council: SOUL contests his statement.

Here is a classic example of the proverb,’ BIRDS OF A FEATHER FLOCK TOGETHER’. These BMC guys have gone to the extent of misguiding the State Chief Minister, Shri Prithviraj Chavhan, in order to save one or more of their corrupt colleague. Their game plan has been exposed by alert and ever vigilant SOUL MATES.

How will Honourable Chief Minister react now? 

Let us wait and watch.

TEXT OF THE RESPONSE TO CHIEF MINISTER’S STATEMENT IN LEGISLATIVE COUNCIL.

Respected Chief Minister,

Sub:    Misleading statement in Maharashtra Legislative Council,

In relation to St. Anthony’s Church, Malwani, Malad (W)

 

At the very outset, we are deeply perturbed by your statement made in the Maharashtra Legislative Council, in response to Notification No. 35, put up by Adv. Ashish Shelar, MLC and others, under Rule 93 on the captioned subject matter. The said statement made by you is based on suppressed facts by the concerned Officers of the Municipal Corporation of Greater Mumbai (MCGM), who have scant respect for religious sentiments of the community, as well as the law of the land.  Had the concerned Officers briefed you in totality with true and proper facts, the statement made by you would prove to be unintended and unjustified. However, it seems there is some hidden agenda on the part of the concerned authorities to misguide you, with vested interests for oblique and collateral consideration. In this context, we wish to apprise you with true and correct facts, so as to dispel any doubts, which you may harbor in relation to the subject matter:

The St. Anthony’s Church and the Priest’s Residence (Parochial House), which is in question, is situated on CTS No. 1667, of which there is no mention at all in your statement. Has it been deliberately omitted to mislead you? We believe so.

The Parochial House, which the BMC intends the Church authorities to surrender, is also over 150 years old and has immense heritage value and has been shown in the attached Extract from MMR – HCS website as a part of the St.Anthony’s Church Complex which is listed as a Grade IIA Heritage structure.

Why do we oppose its acquisition? For the following reasons:

ON HERITAGE STATUS: (URBAN DEVELOPMENT MINISTRY LAWS)

8.1.1 Definitions

a) “Heritage building” means and includes any building of one or more premises or any part thereof and/or structure and/or artifact which requires conservation and / or preservation for historical and / or architectural and / or artisanary and /or aesthetic and/or cultural and/or environmental and/or ecological purpose and includes such portion of land adjoining such building or part thereof as may be required for fencing or covering or in any manner preserving the historical and/or architectural and/or aesthetic and/or cultural value of such building.

b) “Heritage Precincts” means and includes any space that requires conservation and /or preservation for historical and / or architectural and/or aesthetic and/or cultural and/or environmental and/or ecological purpose. Walls or other boundaries of a particular area or place or building or may enclose such space by an imaginary line drawn around it.

8.5 Definitions

“When a building or group of buildings or natural feature areas are listed it would automatically mean (unless otherwise indicated) that the entire property including its entire compound/plot boundary along with all the subsidiary structures and artifacts, etc. within the compound/plot boundary, etc. shall form part of list”

Attached herewith, is an extract from ‘The Mumbai Metropolitan Region – Heritage Conservation Society, (MMR – HCS), established by  Mumbai Metropolitan Region Development Authority (MMRDA).

The layout shown on the right hand side, concurs with clauses 8.1.1 (Definition) and 8.5 (Definition) stated above. The entire precincts, including the over 150 years old Priest’s Residence (Parochial House) has been shown as protected Grade II A Heritage structure. It is needless therefore, to say that only the main structure of St. Anthony’s Church on Malad – Marve Road has been protected as Grade II A; which is incorrect, because it is based on wrong inputs provided by vested interests.

WHY ARE YOU BEING MISLEAD?

To put it bluntly, it is the BMC – Builder Nexus, which has come into play over here. Roads and Traffic Department of BMC, who has the task of drawing a ROAD LINE (RL), had reached a dead end because, we perceive;  Building Proposal Department of BMC, granted approval to construct three buildings on the opposite side of the Church, without taking into consideration the setback for road widening. (Our efforts to obtain approved plans of these buildings, is being repeatedly stonewalled).

To shield their counterparts of the folly, Roads and Traffic Department of BMC has found a soft target in St. Anthony’s Church Property, ignoring the Heritage Status of the 150 years old Parochial House, which is precinct area. Enclosed herewith is a copy of the letter addressed in this context to Mr. Dixit, Chief Engineer, (Roads and Traffic) of BMC, which is self explanatory.

We therefore, Mr. Chief Minister, call upon you to change your perception that only the main structure of St. Anthony’s Church on Malad – Marve Road has been protected as Grade II A and not the 150 years old Parochial House, and advise BMC authorities to swing the ROAD LINE (RL), to its justifiable limit, as demanded in our letter to Chief Engineer R&T.

As regards to the undertaking  given by the Church/School authorities, we are sure, they will stand by it, provided the ROAD LINE (RL), which has been deliberately swung towards Church/ School as cover up for the Builder – BMC nexus, is swung back to its logical spot.

Mr. Chief Minister, We are not opposed to development per se, but the manner in which we, as silent community is being subjected to injustice, is unfortunate, particularly when your party claims to champion the cause of the minorities. The St. Anthony’s Church Trust, in this current phase of Road widening itself, has surrendered over 900 Sq. Meters of Land, within a stretch of around 1 KM of road, without any issue; because we saw no injustice over there.

In the present case, we are opposing INJUSTICE and the BIAS ATTITUDE of BMC and not the LAND ACQUISITION per se.

Mr. Chief Minister, through various sources, SOUL – SAVE OUR LAND committee made many attempts to seek a meeting with you so that you could personally be apprised of our grievance, without success.

We once again request you to consider our genuine request for an audience with you so that the facts may be presented in their proper perspective.

    RUBBISH!!!! While Greg Pereira has definitely done some good work, and is a respected gentlemen, there are a lot of individuals who are nothing but political stooges who have gone sour with the Catholic Church and her leadership, hence they always look for opportunities to wash dirty linen in public, in the name of weeding out corruption.
