Hello Friends,

From the title of this article, you must have understood what we are driving at. Recently, it was in the media that two properties of a prominent film personality were sealed, because he defaulted on his commitment to repay the loan, he had obtained by mortgaging these properties. It was his personal matter.

However, the question is, if these properties are situated on the land belonging to Church, which has been leased to a society of Catholics (Name of the society suggests that the members belong to Catholic Community); can the financial institution, in this case, the two banks, approve loans. We have our doubts, and presume violation of the lease agreements. We have therefore, written to Archbishop, Cardinal Oswald Gracias to look into it, and intervene if necessary. Attached letters to Archbishop should enlighten you.

 

Parish of OUR LADY OF EGYPT CHURCH, KALINA; is in the news these days, for all wrong reasons. Official visit of Archbishop, Cardinal Oswald Gracias is embroiled in unnecessary controversy. We are sure; Cardinal’s permission must have not been obtained to put up his photograph along with a tainted politician. However, we are unable to digest Parish Priest’s statement in the media that he was unaware of it. His proximity to the tainted politician is well known. It is not difficult to understand that visit of Archbishop Cardinal Oswald Gracias was used by Parish Priest to give legitimacy to his association with Corrupt Politician, which has backfired.

Your Eminence,

Enclosed is the copy of a media report, appearing in DNA of 16th, May, 2012 related to attachment of property supposed to be belonging to a renown personality; viz, B. R. Chopra. We would not be much concerned about it, if there was no mention about St. Vincent D’ Paul’s Church, Khar, in that report.

Your Eminence, not many were aware, outside the Khar, Bandra belt, or even within, that the land on which the Garden Homes is located, was leased to St. Vincent D’ Paul CHS for Ninety Nine years by St. Vincent D’ Paul’s Church, Khar. Obviously, it must have been for the benefit of Catholics. We therefore wonder how this property landed in the hands of BR Chopra. Has the Society violated the lease agreement? What does this agreement say? It is very crucial to get answers to these questions. We can’t believe that without the knowledge of someone in the authority, the clause in the agreement was violated.

Your Eminence, as per our knowledge, the checks & balances ensure that a Bank cannot ensure a loan on a leased property. If it is true, the Church authorities should intervene and contest the alleged violation of Leased property. We are sure, this is an opportunity to gain control over Church property by revoking lease agreements, which must have been violated by the Lessee, on many occasions, albeit, with connivance with Parish authorities.

This is another of the many Parishes within Archdiocese of Bombay, where Church properties are being plundered by persons at the helm. We therefore, are not surprised and expect you to get to the root of this incident, looking at it as God sent opportunity, to set right, matters related to Church properties.

Bank seals Mahabharat director’s bungalow

Film-maker Ravi Chopra’s Khar bungalow has been attached by a private bank for not repaying a Rs3.52-crore loan.
Ravi Chopra, son of film-maker BR Chopra, had directed the Mahabharat television series.
“On May 9, the bank officials sealed the property saying that the owners could not repay the loan,” said a security guard at the bungalow located in Garden Homes in Khar (West).
According to the notice, Kotak Mahindra Bank had issued a demand notice to the borrowers on January 17, to repay Rs3.52 crore (as on December 31, 2011, with further interest and other charges till payment) within 60 days. The borrowers include BR TV, a registered partnership firm, and its partners Ravi Chopra, his wife Renu, sons Kapil and Abhay and Ravi Chopra (HUF) and BR Chopra (HUF).
An official from BR Films refused to comment on the issue.
The land on which the Rs5-crore bungalow located in Garden Homes in Khar (West) stands I belong to the St Vincent De Paul Church. “We have given the land on a 99-year lease to the St Vincent De Paul’s CHS. We are not aware of any property attachment over there. Even the bank officials did not inform us,” said a trustee, who did not want to be named.
The bank has attached the property under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002 and The Security Interest (Enforcement) Rules 2002.
Rohit Rao, head of corporate communications of Kotak Mahindra Bank, said: “We will respond you shortly.”

Further to our letter dated 21st, May, 2012; in relation to subject matter, we would like to draw your attention to another media report in today’s DNA.

Bank authorities have sealed another property, belonging to Chopras, which is situated on the land leased by St, Vincent D’Paul Church, Khar, to St. Vincent D’ Paul CHS.

The previous letter suggests the action required to be taken by the church, in order to protect its interest. We hope the Church authorities have intervened in the matter.

Your Eminence, as Catholics, it is our commitment, to alert you of the matters related to properties, belonging to our Mother Church, which we are doing sincerely. How serious you are about protecting our Mother Church from plunderers of her wealth, only your actions will tell.

Defaulter Ravi Chopra’s second property sealed

Filmmaker Ravi Chopra’s other under construction bungalow at Khar (West) has been attached by Cosmos Bank for non-repayment of loan worth approximately Rs61.10 lakh.
Cosmos Bank officials on May 23 struck two possession notices under rule 8 (1) on bungalow number two comprising two flats on the ground and first floor in Garden Homes at Khar. “The bank officials came on Wednesday and sealed the property saying that the owner did not repay the loan within given time,” said a security guard at the bungalow.
According to the notice, Cosmos Bank had issued two demand notices to Ravi Chopra on January 2, asking him to pay Rs67.43 lakh (including further interest till payment) within 60 days.
Cosmos Bank officials confirmed the property attachment but refused to divulge more details. “It was strange to attach the notices on their walls but they have assured us that they will repay the loan soon,” said a bank official.
The bank has attached the property under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, and the Security Interest (Enforcement) Rules 2002.
Bungalow number two was in question in 2010 for allegedly altering its original building plan and converting the residential property into a commercial property as a studio was being constructed by reportedly merging two bungalows.
The BMC officials from H (West) ward office confirmed that it had issued a stop work order notice then.
On May 16, DNA had reported that Chopra’s bungalow number one, which adjoins bungalow number two, was attached by Kotak Mahindra Bank officials for not repaying the loan of Rs3.52 crore approximately.
The land on which the two bungalows, worth approximately Rs15 to Rs20 crore, are located belong to the St. Vincent De Paul Church, which has given the land on a 99-year lease to the St. Vincent De Paul’s Co-operative Housing Society.
Despite repeated attempts through calls and messages, Kapil Chopra, son of Ravi Chopra, remained unavailable for comment.
